Terms and Conditions
These terms and conditions help to keep this
website a safe place to trade and set out the full extent of any
agreement reached between you and timebymail in connection with this
site. You should understand that by placing an order, you accept the
following terms and conditions:
Your contract for purchases made through this web site is with
www.timebymail.com
You agree that e-mail can be used as a long-distance means of
communication.
No contract for the sale of any product will subsist between you and
timebymail unless and until timebymail accepts your order by way of an
e-mail confirming that it has received payment in full for all the goods
you have ordered, and that the goods have been shipped to the specified
address. That acceptance will be deemed complete and will be deemed for
all purposes to have been effectively communicated to you at the time
timebymail sends the e-mail to you (whether or not you receive that
e-mail). This confirmation (not request) e-mail amounts to an
acceptance by timebymail of your offer to buy goods from timebymail or a
3rd party supplier that is engaged on your behalf by www.timebymail.com
You must check that the details on the invoice or confirmatory
email are correct
as soon as possible and you should print out and keep a copy of it.
timebymail will not pass on your personal or credit or debit card
details to any third party.
You undertake that all details you provide to timebymail for the purpose
of ordering or purchasing goods or services are correct, that the credit
or debit card you are using is your own and that there are sufficient
funds to cover the cost of the goods or services ordered.
If there are any changes to the details supplied by you it is your
responsibility to inform www.timebymail.com as soon as possible.
You may cancel items from your order at any time prior to your order
being dispatched, by emailing us at admin@timebymail.com There will be a
15% charge to cover costs and handling fees.
You may also withdraw from the contract at any time after the product
has been dispatched and you have received our email confirming your
order, but no later than 14 working days from the day after you receive
the product. There will be a
15% charge to cover costs and handling fees. Please see our returns policy for further details.
Liability
timebymail does not accept liability for any errors and omissions and
reserve the right to change information, specifications and descriptions
of listed goods, products and services.
timebymail will do its best to correct errors and omissions as quickly
as possible after being notified of them.
timebymail do not accept liability for any indirect loss, consequential
loss, loss of data, loss of income or profit, loss of damage to property
and/or loss from claims of third parties arising out of the use of the
timebymail website or for any products or services purchased from the
timebymail.
timebymail will only be liable for direct loss up to a maximum total of
the price of the product or service purchased in respect of any claim.
Processing of orders
Payments are debited before items are shipped by timebymail. All prices
include sales taxes (where applicable) unless otherwise stated.
timebymail aim to arrange shipment of all in stock items within 24 hours
of receiving your order. Your order may be delayed if the item is not
in stock with our suppliers. Some items may be unavailable and the
current stock status is approximate.
Please note:
Some of our stock is sold on a mail order basis and must be ordered from
our suppliers (please see individual listings). These items can take up
to 28 days to be ordered and delivered.
Delivery/Title/Risk
After full payment is made including the correct postage for your item we will forward your item within 24hrs (unless otherwise instructed). We use EMS UPS and Royal Mail (UK) to deliver all our goods and delivery usually takes between 5-7 days on items we have in stock.
The period stated within which you will receive your order is
approximate. Goods will be sent to the address given by you in your
order and stated in the Order Confirmation. Please note that your goods
may be part-shipped.
Title to any product ordered will pass to you once timebymail has
received payment in full for that product.
If your delivery address is outside of the Kingdom of Thailand you maybe
subject to import duties and taxes, which are levied once a shipment
reaches your country. Any such additional charges for customs clearance
must be paid by you. You should note that customs policies vary widely
from country to country; timebymail advises each customer to contact
their local customs office for further information.
Please note that when shipping products internationally you should be
aware that cross-border shipments are subject to opening and inspection
by customs authorities.
Returns
All our
stock is sold as is, we try to describe our items to the best of our
ability. However, if you are not completely satisfied and you have a
genuine complaint we will gladly give you a full refund (not including
postage). Please return all goods in original packing and as you have
received them. Returned goods can only be credited
if returned in perfect condition, within 14 days of the invoice date.
Goods that have been returned for credit that have been correctly
supplied and described will be subject to a 15% handling charge.
Force Majure
timebymail will not be liable for any breach of agreement, for delay or
failure to perform if the delay or failure is due to acts of God, civil
commotion, riots, floods, drought, fire, legislation or other cause
beyond the timebymail reasonable control. This does not affect your
statutory rights.
Miscellaneous
It is a crime to use a false name or a known invalid credit card to
order. Anyone caught willfully entering an erroneous or fictitious
order will be prosecuted to the fullest extent of the law.
timebymail may amend these terms and conditions from time to time, and
place the new version on the website. All purchases from the date that
the amended terms are placed on our website onwards will be governed by
those new terms.
These terms and conditions shall apply when timebymail accepts your
order by e-mail confirming that it has received payment in full for all
the goods you have ordered. They shall supersede any and all other
conditions, understandings, commitments, agreements or representations
(except fraudulent misrepresentations) relating to your purchase,
whether oral or in writing, and contain the entire agreement between
timebymail and you relating to your purchase. timebymail advises that
you print off and keep safe a copy of these terms and conditions once
your order has been accepted by timebymail.
You are advised to read (and are responsible for reading) all
information on this website fully.
Legal Notices
All material on the Website, including, without limitation, all
informational text, design of and "look and feel," layout, photographs,
graphics, audio, video, messages, interactive messaging design and
functions, files, documents, images or other materials on our Website
(collectively, the "materials"), whether publicly posted or privately
transmitted, as well as all derivative works, are owned by
timebymail.com and/or its affiliates or other parties that have licensed
to or otherwise permitted their material to be used by timebymail.com,
and are protected by copyright, trademark and other intellectual
property laws. timebymail.com disclaims any proprietary interest in
trademarks, service marks, logos, slogans, domain names and trade names
other than its own.
The materials on the Website may not be copied, reproduced, republished,
uploaded, posted, transmitted, or distributed in any way, including by
e-mail or other electronic means without prior written consent. Any
modification of the materials, use of the materials on any website or
networked computer environment, or use of the materials without prior
written consent for any purpose other than personal, non-commercial use
is a violation of the copyright, trademark, and other proprietary rights
in the materials and is expressly prohibited.
All rights not expressly granted herein by timebymail to you are
reserved by timebymail and/or its licensors.
We have a minimum Wholesale order policy of
£50
(GBP). This is to protect our wholesale customers who resell our
products. It also ensures we keep our prices as low as possible.
We have NO minimum order policy regarding retail items. Please email us at admin@timebymail.com for an invoice for the items you require.
